Section 516 · Paragraph 498. Rules for payment during suspension and for counting of suspension period towards pension

The authority ordering the reinstatement of a police officer after suspension should, subject to the Civil Service Regulations and Fundamental Rules, direct the rate at which he is to be paid during the period of suspension and whether that period is to be counted for pension. This order will not affect the grant of horse allowance to the officer, which is governed by subparagraph three of paragraph 496 above.
The authority ordering the reinstatement of a police officer after suspension should confirm or reverse its original order insofar as it relates to the payment of pay during the period of suspension, depending on the outcome of the case and subject to Fundamental Rule 54. The order for the payment of horse allowance will not need to be revised because it will be for a period of three months only, independent of the outcome of the case.
If, on appeal or revision, an order is passed reinstating a police officer who has been dismissed or removed, who has retired, but fails to rejoin his duty within a fortnight from the date of receipt of the order, the authority empowered to dismiss, remove or reduce the person in rank may presume that it is not reasonably practicable to give the said officer an opportunity of showing cause and may proceed in his absence, recording his reasons in writing.
