Section 230 · Paragraph 221. Power of District Magistrate to remove name of fugitive from Fugitive Offenders Register

The District Magistrate may pass an order for the deletion of the name of an offender triable in his district, notwithstanding the non-fulfillment of the conditions given in the preceding paragraph, whenever he is of the opinion that the offence is triable and it is unnecessary to search for the absconder, provided that he shall not thereby expunge an offence which is triable by the Court of Sessions as a whole.
The District Magistrate shall, once a year, either by inspection of the police station or by examination of the list of absconding offenders, consider whether any name should be deleted. Whenever the name of an absconding offender is deleted by the District Magistrate or a police officer, no prosecution shall be instituted against him except on complaint, without the sanction of the District Magistrate.
