Section 287 · Paragraph 278. Manner of execution of warrant for recovery of fine by attachment and sale of movable property

The execution of a warrant for the recovery of a fine by attachment and sale of movable property shall be carried out in the following manner:
(1) Such a warrant shall ordinarily be directed through the Public Prosecutor to the police station within whose jurisdiction the property of the offender is situated, and the Station House Officer may endorse it to any of his subordinate police officers.
(2) The person liable shall first be demanded to pay the fine.
(3) If payment is made to the police officer on demand, he shall pay the money to the nearest treasury or sub-treasury, and the warrant shall be returned to the court with an endorsement of execution.
(4) If payment is not made immediately, the police officer carrying the warrant shall attach such movable property of the person fined as is sufficient to satisfy the fine. He shall then return the warrant to the Magistrate with this endorsement and a note as to what has been done.
(5) If it becomes necessary to sell the property attached, the sale shall be made not by a police officer but by the Nazir or the Sucker Amin under the orders of a Magistrate.
