Section 449 · Paragraph 438. Committee on Determination of Seniority

The Inspector General will annually determine the total number of names to be included in the provincial list of officers approved for permanent promotion to the rank of Public Prosecutor and Divisional Inspector, and will convene a committee to select the number of Sub-Inspectors required to fill this list and to determine their seniority for the purpose of permanent promotion.
Note
This provides that the Inspector General of Police will determine the number of officers to be approved for permanent promotion to the rank of Divisional Inspector and will convene a committee to select from among the Sub-Inspectors and determine their seniority. The Deputy Inspector General has no option other than to appoint Sub-Inspectors from the list approved by the Inspector General as Divisional Inspectors. The word "appointment" used in this paragraph is interpreted as equivalent to "posting," and this remains a ministerial function for a junior officer. The approval of the Inspector General for promotion of Sub-Inspectors to the post of Divisional Inspector in a series of posts shall be deemed to be that of the competent authority to appoint them from the post of Sub-Inspector to the post of Divisional Inspector. This is the decision of the Allahabad High Court dated 22-9-71 in Second Appeal No. 1259/70 of State vs. Chandrapal Singh.
