UP Police Regs 163Chapter 13 · Arrest, Bail and Custody
Section 163 · Paragraph 155. Instructions for the application of handcuffs and shackles to acquitted and undertrial prisoners
Text size — level 1 of 4
No person arrested should be subjected to unnecessary hardship or humiliation. The instructions for handcuffing and shackling convicted and undertrial prisoners contained in the Guard and Route Signs Rules shall, as far as possible, apply to all arrested prisoners on their way to the police station and from outstations to headquarters.
Visits to friends and legal advisers shall be permitted, subject to such precautions as may be necessary to prevent the prisoner from escaping or otherwise defeating the ends of justice. If handcuffs are to be used, a pair should be selected that fits the prisoner's wrists, and the key to the same should be kept in the breast pocket of the police officer in charge of the prisoner.
For road travel, if the prisoner or arrested person wishes to travel in a hired vehicle, he or she should be permitted to do so, provided he or she is willing to pay his or her own fare and that of the escort.
When travelling by train, a prisoner or arrested person shall ordinarily travel in a third class compartment, but if the prisoner or arrested person is willing to pay the higher class fare including the police escort, he should be allowed to travel in the class of his choice.
