Section 176 · Paragraph 168. Responsibility of Public Prosecutor in Disposal of Property

The Public Prosecutor shall be responsible that the orders of the Court relating to the disposal of the property have been duly complied with and, when satisfied that such a thing has been done, shall give a certificate to that effect on the Malkhana Register. Before giving such certificate, the Public Prosecutor shall— (a) in the case of property returned to the police station for disposal, examine the report of the Station House Officer authenticating the signatures of receipt; (b) in the case of property handed over to a party in the Court, see the Magistrate's certificate on the list of property; (c) in the case of property sent for deposit in the Treasury, see the receipt of the Treasury Officer before sending it to the Court concerned; and (d) in the case of property ordered to be destroyed before a Magistrate, see the signature of the Magistrate on the list of property certifying that such has been done.
