In all recruitments and promotions contained in Chapters 21 and 30, appointments to Scheduled Castes and Scheduled Tribes will be made in accordance with the reservations provided by the Government from time to time.
Note
If a candidate has an adverse entry in his character roll against which an appeal is pending, that entry will not be considered by the Selection Committee.
In Jaipal Singh Naresh vs. State, it was decided that in considering the merits of a candidate, the Selection Committee will, among other things, consider his service record, character, and adverse entries. However, an adverse entry against which an appeal is pending will not be considered and will be set aside until a final decision is reached.
In Government Order No. 6379/8-A, dated 5-11-65, the selection process for Divisional Inspectors from Sub-Inspectors is given. G.O. 4072/8-A 10 (13) 66, dated 27-10-66, the selection process for Public Prosecutors from Assistant Public Prosecutors states that for substitute or permanent vacancies, the selection process of the above mentioned Divisional Inspectors will be applicable. The spirit of this mandate is that selection should be based on merit. The test adopted by the selection committee was competitive, not qualification. Such a test requires that all candidates' abilities be considered together, and a list of all candidates is prepared in order of merit, and the required number of candidates are selected from that list in order of merit. This is the only way to determine the comparative merit of candidates. If the selection process is conducted in batches, the results will be declared only after interviews for all batches, and only then will the comparative merit of candidates be accurately evaluated. On the other hand, if the results for each batch are declared separately, this will be a merit determination among the candidates within the batch, not for the entire group of candidates, and this process will only lead to distorted results. The applicant's argument was recognized in the aforementioned case, Jaipal Singh Naresh vs. State.
