धारा 60 · Sale to be by public auction

- Section 76(1). - (1) The sale of the mortgaged property shall be subject to the previous charge, if any, on the basis of a registered deed on the property, and shall be by public auction to the highest bidder.

(2)

The sale officer may, in his discretion, adjourn the sale to a specified day and hour, recording his reasons for such adjournment.

(3)

Where a sale is adjourned under sub-rule (2) for a longer period than seven days, a fresh proclamation under rule 59 shall be made and published unless the mortgagor consents to waive it.
