Section 151 · Saving in respect of certain matters of Chapter 12

Nothing in Chapter 12 shall-
(a) exempt any person from any suit or other proceeding which, but for anything in that Chapter, might have been brought against him; or
(b) entitle any person to refuse to make a full disclosure or to answer any question or interrogatory in any suit or other proceeding, but such disclosure or answer shall not be admissible in evidence against such person in any prosecution for any offence under this Chapter or in relation to clause (h) of section 112 of the Customs Act, 1962 (52 of 1962), relating to confiscation of goods under clause (d) of section 111 of that Act and notified by the Central Government under clause (d) of sub-section (2) of section 11 thereof for the protection of trade mark relating to the import of goods; or
(c) shall not be construed to render any servant of a principal resident in India who has acted in good faith in obedience to the instructions of such principal and has, on demand by or on behalf of the prosecution, given full information with regard to his principal and the instructions which he received from his principal, liable to any prosecution or punishment.
