धारा 2 · Definitions

- In this Act, unless the context otherwise requires, -[* * * * * * *] [[Clause (a) omitted by W.B. Act 24 of 1985, which was as under :-'(a) 'aided library' means a recognised library receiving aid from the Government, or from a Local Library Authority;'.]]

(aa)

[ "Calcutta Metropolitan Library" means the District Library in Calcutta declared by the State Government as such;] [Clause (aa) inserted by W.B. Act 8 of 1982.]

(bb)

[ "Corporation" means the Calcutta Municipal Corporation established under the Calcutta Municipal Corporation Act, 1980;] [[Clause (bb) first inserted by W.B. Act 8 of 1982, then substituted by W.B. Act 24 of 1985. Previous clause (bb) was as under :-

'(bb) 'Corporation' means the Corporation of Calcutta as constituted under the Calcutta Municipal Act, 1951;'.]]

(bbb)

[ "Darjeeling Gorkha Hill Council" means the Darjeeling Gorkha Hill Council constituted under the Darjeeling Gorkha Hill Council Act, 1988;] [Clause (bbb) inserted by W.B. Act 7 of 1998.]

(c)

"Director" means the Director of [Library Services] [Words substituted for the words 'public libraries' by W.B. Act 8 of 1982.] appointed under section 6;

(d)

[ "District" means a district of West Bengal and includes Calcutta as defined in the Calcutta Municipal Corporation Act, 1980;] [[Clause (d) first substituted by W.B. Act 8 of 1982, then again substituted by W.B. Act 24 of 1985. Previous clause (d) was as under :-

'(d) 'district' means a revenue district;'.]][* * * * * * *] [[Clause (dd) first inserted by W.B. Act 8 of 1982, then omitted by W.B. Act 24 of 1985, which was as under :-'(dd) 'District Librarian' means the person placed in charge of a District Library to be called the District Librarian under clause (i) of sub-section (2) of section 16, and includes the Librarian of the Calcutta Metropolitan Library;'.]]

(ddd)

[ "District Library Officer" means the person appointed to be called the District Library Officer under section 16;] [[Clause (ddd) first inserted by W.B. Act 8 of 1982, then substituted by W.B. Act 7 of 2003. Previous clause (ddd) was as under :-

'(ddd) 'District Library Officer' means the person appointed to be called the District Library Officer under sub-section (1) of section 16;'.]][* * * * * *] [[Clause (e) omitted by W.B. Act 24 of 1985, which was as under :-'(e) 'District Library' means a library in a district established or recognised by the Government as the District Library;'.]]

(f)

"Government" means the Government of the State of West Bengal;

(ff)[ "Library" means a public library [* * * * * *] [[Clause (ff) first inserted by W.B. Act 8 of 1982, then substituted by W.B. Act 24 of 1985. Previous clause (ff) was as under :-

'(ff) 'Library' includes an aided library, District Library, public library, or recognised library, but does not include a private library;'.]];]

(g)

"notification" means a notification published in the Official Gazette;

(h)

"prescribed" means prescribed by rules made under this Act;

(j)

[ "Public Library' means a library open to the public, and includes - [[Clause (j) first amended by W.B. Act 8 of 1982, then substituted by W.B. Act 24 of 1985, then again substituted by W.B. Act 41 of 1994. Previous clause (j) was as under :-

'(j) 'public library' means a library open to the public and -

(i)

established or maintained by the Government, or

(ii)

declared by the Government as a sponsored public library under section 16A;'.]]

(i)a Government Public Library,

(ii)the State Central Library,

(iii)

a sponsored public library declared as such under section 16A, or

(iv)

such other library as the Government may declare to be a public library;]

(j1)

[ "Siliguri Mahakuma Parishad" means the Mahakuma Parishad for the sub-division of Siliguri in the district of Darjeeling constituted under section 185B of the West Bengal Panchayat Act, 1973;] [Clause (j1) inserted by W.B. Act 7 of 1998.]
