धारा 38 · Restrictions on defaulting member to vote at election or to represent a society in any other society

- No member shall be entitled to vote at any election in the society of which he is a member or be entitled to be elected or nominated to represent the society in any other society or to vote at any election in the other society if on thirty days prior to the date of election,-(i)he was in default to the society of which he is a member or any other society, for a period exceeding three months; or (ii)a decree has been obtained against him and the decree is subsisting; or (iii)proceedings have been initiated against him under sections 118,119,120 or 144 for recovery of any debts and the debt has not been fully discharged; and (i)the society he represents is in default to any other society for a continuous period of one year and the default exceeds thirty per cent of the sum due by that society; or (ii)a decree has been obtained against the society he represents and the decree is subsisting.
