धारा 2 · Amendment of the Schedule to Bihar Regulation 1 of 1969

- Under the heading 'Bengal Act' of the Schedule to the Bihar Scheduled Areas Regulation, 1969 (Bihar Regulation 1 of 1969)-

(i)

In Section 71-A of the Chota Nagpur Tenancy Act, 1908 noted against serial No. 3 in column (4)-

(a)

after the word "Raiyat" the words "or a Mundari-Khunt-Kattidar or a Bhuinhar" shall be inserted; and

(b)

after the word and figure "Section 4" the words and figures "or Section 48 or Section 240" shall be inserted;

(ii)

Under the heading "Bihar Act" of the Schedule to the said Regulation, "serial numbers 4 and 5 and columns (1) to (4) thereof" shall be omitted;

(iii)

Serial number "6" shall be renumbered as serial number "4"; and

(iv)

In serial number 4 as so renumbered, after the second proviso to subsection (5) of Section 20 of the Santhal Parganas Tenancy (Supplementary Provisions) Act, 1949 noted in column (4), the following explanation shall be added thereto and shall be deemed always to have been added, namely:

Explanation. - In this section "Substantial structure or building" means the structure or building of the value exceeding ten thousand rupees, as determined by the Deputy Commissioner on the date of holding enquiry, but it does not include such structure or building the material of which can be removed without incurring substantial depreciation in its value.
