Section 2 · Section 39 (3)

- The Additional District Magistrate (Planning) or the District Planning Officer, as the case may be, the District Medical Officer of Health, the Deputy Inspector of Schools, the District Panchayat Raj Officer, the Senior Mechanical Inspector (Minor Irrigation), the District Livestock Officer, the District Agriculture Officer and the Assistant Registrar, Co-operative Societies exercising jurisdiction in the district or the District Co-operative Officer, as the case may be, of the State Government shall hold respectively the posts of Mukhya Adhikari, Swasthya Adhikari, Shiksha Adhikari, Panchayat Raj Adhikari, Sinchai Adhikari, Pashudhan Adhikari, Krishi Adhikari and Sahkarita Adhikari, under the [Zila Panchayat] [Substituted by U.P. Act No. 9 of 1994.] on the following terms and conditions :

(i)

The appointing authority in respect of the aforesaid officers shall continue to be the same as before.

(ii)

The entire expenditure on account of pay, allowances and pensions, etc. shall continue to be borne by the State Government.

(iii)

The power to dismiss, remove from service or reduce in rank or to a lower stage in time-scale or stop increments shall continue to vest in the respective Government authorities, who enjoy that power over these officers as Government servants.

(iv)

The power to inflict minor punishment such as warning and censure shall vest in the Government authority as hitherto.

(v)

The transfer of these officers from one district to another will continue to be made by the respective Government authorities.

(vi)

The power to sanction any leave, other than the casual leave to the Mukhya Adhikari and other officers shall vest in the State Government authorities concerned as hitherto.
