Section 2 · Manner of supersession

(1)

If in the opinion of the State Government the Board fails or neglects to perform any duty imposed on it by or under the Rajasthan Housing Board Act, 1970 within the period fixed for its performance, under sub-section (1) of section 61 of the said Act, the State Government shall draw up a statement indicating the charge against the Board and send the same to the Board for explaining its position in writing to the said charges within a period of 15 days from the date the said statement is received by the Board.

On receipt of the reply of the Board under sub-rule (1) or in case where no reply has been received from the Board within the prescribed time, the State Government shall consider the matter and if satisfied that the Board has failed or neglected to perform the duty imposed upon it, within the period prescribed under sub-rule (1) may pass an order with the reasons thereof, superseding the Board with effect from the date notified in the said order and publish it in the Official Gazette.
