(क) चेक प्रस्तुत किए जाने के समय कोई विधितः प्रवर्तनीय ऋण या दायित्व नहीं था। चेक ऊपर बताए अनुसार प्रतिभूति के रूप में / ऋण-उन्मोचन से भिन्न प्रयोजन के लिए दिया गया था। धारा 139 की उपधारणा अधिसंभाव्यता की प्रबलता पर खंडनीय है (रंगप्पा बनाम श्री मोहन, (2010) 11 SCC 441; बसालिंगप्पा बनाम मुदिबसप्पा, (2019) 5 SCC 418), और ऊपर के तथ्य उसका खंडन करते हैं।
(ख) चेक की रकम का भुगतान आपके नोटिस की प्राप्ति से पंद्रह दिन के भीतर दिनांक ................ को ................ (विवरण) द्वारा कर दिया गया है। धारा 138 के परंतुक के खंड (ग) के अनुसार उस अवधि में भुगतान हो जाने पर कोई अपराध नहीं बनता।
